Wax Agreement

Welcome and thank you for visiting www.waxjean.us (the «Website»). Please read the following terms of use, including an arbitration agreement governing your use of the Site («agreement»), and create a legally binding agreement between you and Blue Dot USA, Inc. dba Wax Jean and its affiliates (collectively, the «Company» or «we» or «us» or «our») with respect to your use of this Site. This Agreement shall be governed by and construed in accordance with the laws of the State of California, without regard to choice of law principles, except as set forth above. The waiver of any provision of the Agreement shall not be deemed a waiver of any other provision or of the Company`s right to require strict compliance with any of the terms and conditions contained herein. If any provision of the Agreement is held to be unenforceable or invalid for any reason, that provision shall be severable and all other provisions shall remain in full force and effect. This Agreement constitutes the entire agreement between us with respect to your use of the Site. Except as otherwise provided herein, these Terms constitute the entire agreement between user and EPH with respect to WAX Products and these Terms supersede all prior or contemporaneous communications and proposals, whether electronic, oral or written, between User and EPH with respect to WAX Products, with the exception of the Token Terms you have entered into with EPH. A printed version of these Terms and all communications in electronic form will be admissible in judicial or administrative proceedings based on or related to these Terms to the same extent and under the same conditions as other business documents and records originally created and maintained in printed form.

The parties expressly wish that these Terms and all related documents be written in English. If you use WAX Cloud Wallet, you are responsible for maintaining the confidentiality of your account and password and are fully responsible for all activities that occur under your password or account. You are responsible for restricting access to your computer or other electronic devices through which you use WAX Cloud Wallet, and you agree to accept responsibility for all activities that occur under your account or password. You may not assign or transfer your account to any other person or entity. You acknowledge that EPH is not responsible for third party access to your account resulting from the theft or misappropriation of your account or password. EPH and its employees reserve the right, in their sole discretion, to refuse, terminate or suspend the Service, terminate accounts and/or remove or modify content. Our decision to exercise any of these rights is not exclusive and does not affect our right to take further action at any time. We may use any of these rights in combination with one or more other rights and/or remedies available to us under these Terms, any other agreement we have with you, applicable law or in equity. You agree to (a) notify us immediately of any unauthorized use of your password or account or any other breach of security, and (b) ensure that you exit your account at the end of each session when you access WAX Cloud Wallet. We will not be liable for any loss or damage resulting from your failure to comply with this section. These Terms of Use constitute the entire agreement between you and Natura Sugaring Melt & Wax Spa and govern the use of our Services and supersede any previous version of these Terms of Use between you and us with respect to the Natura Sugaring Melt & Wax Spa Services.

You may also be subject to additional terms that may apply when you use or purchase certain other Natura Sugaring Melt & Wax Spa services, affiliated services, third-party content or third-party software. (3) If you and EPH do not settle the claim within sixty (60) calendar days of receipt of the notice, you or EPH may initiate arbitration. During the arbitration, the amount of a settlement offer will not be communicated by EPH or you to the arbitrator until the arbitrator determines the amount to which you or EPH may be entitled. As used in this section, «we», «us» and «our» refer to Exposition Park Holdings. In addition, «we» and «us» include any third party that provides products, services or benefits in connection with any of the WAX Products or these Terms (as well as any related or prior agreements you may have entered into with us) if such third party is named as a party with us in a controversy, dispute, a claim, affirmation or cause of action under this Section. It is by mutual agreement between you and Natura Sugaring Melt & Wax Spa with respect to the Terms of Use that the relationship between the parties shall be governed by the laws of the State of California, without regard to its conflict of laws rules, and that any claim, cause of action and/or dispute arising out of or in connection with the Terms of Use or the relationship between you and Natura Sugaring Melt & Wax Spa, must be filed in the competent courts of San Diego County, California, or the United States District Court in that state. You and Natura Sugaring Melt & Wax Spa agree to submit to the jurisdiction of the courts as set forth above and agree to waive any objection to the exercise of jurisdiction over the parties by such courts and the jurisdiction of such courts. WAX products are very diverse, so sometimes additional conditions or product requirements (including age requirements) may apply. Additional terms are available for the relevant WAX products, and these additional terms are part of your agreement with us when you use those WAX products. Some of the WAX products are also subject to additional third-party terms and conditions. If you use any of these WAX products, these additional third party terms and conditions will be provided and will form part of our agreement with you.

To the extent that additional terms or third party terms and conditions conflict with these terms, third party additional terms apply to the extent of the conflict. a) Violations or breaches of our Terms of Use or any other incorporated agreement, regulation and/or you acknowledge, understand and agree hereto, except as expressly provided in these Terms of Use, that there will be no third party beneficiaries of this Agreement. Natura Sugaring Melt & Wax Spa may send you notices, including those relating to changes to the Terms of Use, including, but not limited to, emails, regular mail, MMS or SMS, text messages, postings on our website or other reasonable means that are currently known or may be contained herein after development. Such communications cannot be received if you violate any aspect of the Terms of Use by accessing our Services without authorization. Your acceptance of these Terms of Use constitutes your acceptance that you will be deemed to have received all communications that would have been delivered if you had accessed our Services in an authorized manner.
